Terms and Conditions (Terms of Service)

Please read these Terms and Conditions ("Terms", "Agreement") carefully before downloading, installing, accessing, or playing Retro Tank ("Game", "App", "Service") published by Thomas ("Developer", "we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, accessing, or playing Retro Tank on the web, Apple iOS devices (via the Apple App Store), or Android devices (via the Google Play Store), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, do not install, access, or play the Game.

2. Eligibility & Age Requirements

You must be at least 13 years of age (or the legal age of digital consent in your jurisdiction) to play the Game. If you are under the legal age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License Grant & Restrictions

We grant you a personal, revocable, non-exclusive, non-transferable, limited license to install and play the Game for personal, non-commercial entertainment on compatible devices you own or control.

You agree that you will not:

• Reverse engineer, decompile, disassemble, or extract source code from the Game.
• Modify, adapt, sell, lease, sublicense, distribute, or commercially exploit the Game.
• Use cheats, hacks, automation bots, or memory editors to alter gameplay or manipulate scores.
• Remove or obscure any copyright, trademark, or proprietary notices.

4. Intellectual Property Rights

All rights, title, and interest in and to the Game—including source code, artwork, sprites, animations, sound effects, audio compositions, and design layouts—remain the exclusive property of the Developer and its licensors. No ownership rights are transferred to you under these Terms.

5. Local Storage & Saved Progress

Retro Tank does not require user accounts. Game progress, stage unlocks (Campaign mode), best stages, high scores (Arcade mode), and audio settings are stored locally on your device (via browser localStorage or local sandboxed storage). Clearing app data, clearing browser cache, uninstalling the app, or formatting your device may delete this data. The Developer is not liable for lost, corrupted, or unrecoverable progress.

6. Telemetry & Crash Diagnostics

The Game integrates error-monitoring and diagnostic tools (including Sentry) to record application crashes, performance bottlenecks, and non-personal game telemetry (such as stage progression and power-up event tallies). This data is used solely to maintain stability, fix software bugs, and balance gameplay difficulty.

7. Platform-Specific Terms

A. Apple App Store (iOS)

If you downloaded the Game from the Apple App Store:

• These Terms are between you and the Developer only, not Apple Inc. ("Apple").
• Apple has no obligation whatsoever to furnish maintenance or support for the Game.
• Apple is not responsible for addressing any claims relating to the Game or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

B. Google Play Store (Android)

If downloaded via Google Play, you agree to comply with Google Play's Terms of Service and applicable policies.

8. Disclaimer of Warranties

THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, DEVICE DAMAGE, BATTERY DRAIN, OR INTERRUPTION OF BUSINESS. IN NO EVENT SHALL TOTAL LIABILITY EXCEED $10.00 USD (OR THE AMOUNT PAID BY YOU FOR THE APP, IF ANY).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.
