Terms and Conditions (Terms of Service)

Please read these Terms and Conditions ("Terms", "Agreement") carefully before downloading, accessing, or using the Seasonal Chefs mobile application ("App", "we", "us", or "our"). By accessing, downloading, creating an account, signing in, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use or access the App.

1. Acceptance of Terms

By using Seasonal Chefs, you confirm that you are at least 13 years of age (or the minimum legal age required in your jurisdiction) and possess the legal capacity to enter into this Agreement. If you are using the App on behalf of an organization or business, you represent that you have the authority to bind that entity to these Terms.

2. User Accounts and Registration

1. Account Creation: Certain features (such as cloud syncing of recipes, meal planning, and shopping lists) require an account. You may register and sign in using your email address or supported third-party identity providers (e.g., Google Sign-In, Apple Sign-In).
2. Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach.
3. Accuracy of Information: You agree to provide accurate and complete registration information and keep your account details up to date.

3. Data Ownership, User Submissions & Server Syncing

1. Server Data Ownership: By signing into the App and transmitting, uploading, saving, or syncing any data, recipes, ingredient lists, instructions, notes, images, comments, or other materials to our servers ("Server Data" and "User Content"), you acknowledge and agree that all such data and content submitted to our servers becomes the property of Seasonal Chefs thereafter.
2. Perpetual, Worldwide Rights: To the maximum extent permitted by applicable law, your submission of data constitutes a full transfer and assignment of ownership to Seasonal Chefs. Where assignment is restricted by law, you hereby grant Seasonal Chefs an exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to use, host, store, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, and commercialize such content across any media or platform without compensation, royalty, or prior notice to you.
3. User Representations & Warranties: You represent and warrant that:
   • You own or have obtained all necessary rights, licenses, and permissions to upload and submit any recipes, text, images, or materials you provide.
   • Your submissions do not infringe upon any third party's intellectual property, copyright, trademark, privacy, or publicity rights.
   • Your submissions do not contain unlawful, defamatory, offensive, or harmful material.
4. No Obligation to Retain: While we take reasonable measures to safeguard server data, we are under no obligation to permanently store, maintain, or return any User Content or Server Data to you. You are strongly advised to keep independent local records of any recipes or data you value.

4. Hosting, Infrastructure & Third-Party Service Providers

1. Google Servers (Google Cloud Platform & Firebase): You acknowledge and agree that your account information, authentication records, database entries, recipe data, and server synchronization are hosted, processed, and stored on Google servers via Google Cloud Platform and Firebase (operated by Google LLC and its affiliates).
2. Sentry Servers (Functional Software, Inc.): To monitor application stability, detect bugs, and diagnose performance errors, the App collects diagnostic telemetry, stack traces, and crash reporting data. You acknowledge and agree that these error and diagnostic logs are transmitted to and hosted on Sentry servers (operated by Functional Software, Inc. d/b/a Sentry).
3. Third-Party Terms: Your use of features that rely on third-party services (such as Google, Apple, or Sentry) may additionally be subject to the terms and privacy practices of those respective third-party providers.

5. Permitted Use and Restrictions

You agree to use Seasonal Chefs strictly in accordance with these Terms and applicable laws. You agree not to:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App.
• Use automated scrapers, bots, crawlers, or harvesting tools to extract data, seasonal charts, produce guides, or user content from the App without prior written consent.
• Interfere with, disrupt, or place an unreasonable load on the servers, networks, or infrastructure supporting the App (including Google and Sentry servers).
• Use the App for any fraudulent, unlawful, or unauthorized commercial distribution purposes.

6. Intellectual Property of Seasonal Chefs

Except for user submissions, all rights, title, and interest in and to the App—including but not limited to software code, databases, design layouts, logos, branding, seasonal produce calendars, culinary guides, supermarket price comparison compilations, icons, and visual graphics—are and remain the exclusive intellectual property of Seasonal Chefs and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial culinary use on compatible devices.

7. Disclaimers: Nutritional, Seasonal & Pricing Information

1. Informational & Reference Use Only: The information provided in Seasonal Chefs (including seasonal availability windows, supermarket price comparisons, ingredient suggestions, and recipes) is provided for general informational and reference purposes only.
2. No Guarantee of Agricultural or Pricing Accuracy: Agricultural produce seasons, harvesting times, and availability in the UK or other regions depend heavily on local climate, farming conditions, and distributor supply. Supermarket prices change frequently and may vary by retailer, store location, or quality tier. We make no warranty that information is always completely up to date, comprehensive, or error-free.
3. Food Safety, Dietary and Allergen Caution: You are solely responsible for verifying food safety, storage requirements, cooking temperatures, and potential allergens (e.g., nuts, gluten, shellfish, dairy) before preparing or consuming any food item or recipe featured in or stored through the App. Seasonal Chefs is not responsible for adverse culinary outcomes, illnesses, allergic reactions, or injuries.

8. Disclaimer of Warranties ("As Is")

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT DEFECTS WILL BE IMMEDIATELY CORRECTED.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SEASONAL CHEFS, ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, SERVICE INTERRUPTIONS, SERVER DOWNTIME (INCLUDING GOOGLE OR SENTRY SERVICE OUTAGES), OR PERSONAL INJURY RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF £20 GBP OR THE AMOUNT ACTUALLY PAID BY YOU TO USE THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Account Deletion and Termination

1. Termination by You: You may delete your account at any time using the in-app "Delete Account" button within the My Account / Profile section of the App.
2. Termination by Us: We reserve the right to suspend, terminate, or restrict your access to the App or servers at our sole discretion, without prior notice, if we believe you have breached these Terms or engaged in conduct detrimental to the App or other users.
3. Survival of Terms: Upon account termination or deletion, sections relating to Server Data Ownership, Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law shall continue in full force and effect.

11. Amendments to Terms

We may update or revise these Terms from time to time. When changes are made, the "Last Updated" date at the top of this document will be revised. Continued use of the App following any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue using the App.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, without giving effect to conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction to resolve any disputes arising from or relating to these Terms.
